Terms of Service
These terms of service (“Terms”) govern your use of the StoreTrack store locator tool (“StoreTrack” or the “Service”), provided by Perspective Design ("StoreTrack", "we", "us", or "our"). By using StoreTrack, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using StoreTrack, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, you may not use StoreTrack.
2. User Eligibility
StoreTrack is intended for use by individuals who are at least 18 years old. By using StoreTrack, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
3. Store Locator Tool
StoreTrack provides a store locator tool that allows users to search for and find stores located in The Netherlands. The accuracy and availability of store information provided by StoreTrack may vary and is subject to change without notice.
4. Use of StoreTrack
4.1 You may use StoreTrack solely for personal, non-commercial purposes in accordance with these Terms.
4.2 You agree not to:
- Use StoreTrack for any illegal or unauthorized purpose.
- Modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of StoreTrack.
- Interfere with or disrupt the operation of StoreTrack or the servers or networks used to make StoreTrack available.
- Attempt to gain unauthorized access to StoreTrack or any related systems or networks.
4.3 We reserve the right to terminate or suspend your access to StoreTrack at any time without notice if we believe you have violated these Terms.
5. User Content
5.1 StoreTrack may allow users to submit, post, or display content, such as reviews, ratings, or comments (“User Content”). By submitting User Content, you grant StoreTrack a non-exclusive, worldwide, royalty-free, sub-licenseable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with StoreTrack.
5.2 You are solely responsible for any User Content you submit, and you represent and warrant that you have all rights necessary to grant StoreTrack the license described in Section 5.1.
5.3 StoreTrack reserves the right to remove or modify any User Content at any time for any reason.
6. Intellectual Property
6.1 The Service and its original content, features, and functionality are and will remain the exclusive property of StoreTrack and its licensors. The Service is protected by copyright, trademark, and other laws of both the Netherlands and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of StoreTrack.
6.2 Any feedback, comments, or suggestions you provide regarding StoreTrack may be used by StoreTrack without any obligation to compensate you.
7. Third-Party Links
StoreTrack may contain links to third-party websites or services that are not owned or controlled by StoreTrack. StoreTrack has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that StoreTrack shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.
8. Disclaimer of Warranty
8.1 StoreTrack is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, and hereby disclaim and negate all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
8.2 We do not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of StoreTrack or otherwise relating to such materials or on any sites linked to StoreTrack.
9. Limitation of Liability
9.1 In no event shall StoreTrack, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use StoreTrack; (ii) any conduct or content of any third party on StoreTrack; (iii) any content obtained from StoreTrack; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found.
